TERMS & CONDITIONS
Whyte Films

These Terms and Conditions apply to all services provided by Whyte Films (“the Videographer”) to the Client. By approving a quote, confirming a booking, or engaging services in any form, the Client agrees to the following:

1. Payment Terms
Full payment is required prior to the agreed shoot date unless otherwise agreed in writing. Whyte Films reserves the right to withhold delivery of any and all content, including raw and edited materials, until full payment has been received. Late payments may result in cancellation, rescheduling, or additional fees.

2. Estimates and Variations
All quotes are estimates only and may vary. The final invoice may increase due to unforeseeable or additional circumstances, including but not limited to additional travel costs, extended shoot time, additional content requests, additional edits or revisions, or work outside the original agreed scope. Where reasonably possible, additional costs will be communicated prior to being incurred.

3. GST
All quoted and invoiced prices are exclusive of GST unless otherwise specified. GST will be added where applicable in accordance with current legislation.

4. Equipment Damage and Liability
The Client is responsible for maintaining a safe shooting environment. If any equipment owned or hired by Whyte Films is damaged, destroyed, or lost due to the actions or negligence of the Client, the Client’s representatives, talent engaged by the Client, or any patrons or third parties permitted by the Client to be present, the Client agrees to reimburse 100% of the repair or replacement cost unless otherwise agreed in writing.

5. Ownership and Intellectual Property
All footage, photography, raw files, edited materials, and derivative works remain the sole property of Whyte Films at all times, regardless of payment status. Approval of a quote constitutes acknowledgment that all content captured remains the property of Whyte Films. Upon full payment, the Client is granted a non-exclusive, non-transferable licence to use the final delivered content for agreed marketing and promotional purposes. Ownership rights are not transferred unless expressly agreed in writing and subject to an additional fee.

6. Usage and Licensing
The licence granted permits use of the final delivered content for the Client’s organic marketing, social media, and website promotion. Any paid advertising, broadcast use, third-party distribution, or sublicensing must be agreed in writing and may be subject to additional licensing fees. The Client may not resell, sublicense, or materially alter the content without prior written consent.

7. Creative Control and Revisions
Whyte Films retains full creative control over filming and editing style. Revision rounds are limited to those specified in the quote or agreement. Additional revisions or substantial changes to the original brief may incur further charges.

8. Cancellations and Rescheduling
Cancellations or rescheduling requests must be made in writing. Whyte Films reserves the right to charge a cancellation fee for late cancellations. Whyte Films also reserves the right to reschedule due to illness, equipment failure, unsafe conditions, or circumstances beyond reasonable control.

9. Client Responsibilities
The Client is responsible for securing all necessary permissions, permits, and approvals from venues or gym management. The Client is responsible for ensuring that all participants are physically capable of performing required activities. Whyte Films accepts no liability for injuries or incidents occurring during the shoot.

10. Marketing and Portfolio Use
Whyte Films reserves the right to use any content created for portfolio, website, social media, showreel, and promotional purposes unless otherwise agreed in writing prior to the shoot.

11. Limitation of Liability
Whyte Films will take all reasonable care in capturing and storing content. However, liability for any claim arising out of the provision of services is limited to the total amount paid by the Client for the relevant project.

12. Revisions
We include up to four (4) revision rounds as part of the agreed scope of work. Each revision may involve changes affecting no more than ten percent (10%) of the original delivered materials. Revisions exceeding this limit, or any request for additional deliverables beyond the original scope, will be considered out of scope and may incur additional fees. Any such additional work will be quoted and approved prior to commencement.

13. Acceptance
Approval of a quote, confirmation of a booking, or participation in a scheduled shoot constitutes full acceptance of these Terms and Conditions.

CANCELLATION POLICY

Cancellations made within 24 hours of your booking with Whyte Films will be charged 100% of the service fee.
